By downloading, installing, or using Vitality365, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app. These terms apply to all users, including users who access the app as guests without creating an account.

2. Not Medical Advice

Vitality365 is a personal wellness tracking tool designed to help you organize and monitor your daily health habits. It is not a medical device, and it is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Specifically:

• Medication interaction alerts are for general awareness only and are not a substitute for advice from your pharmacist or physician.
• Fall risk assessments are based on self-reported information and are not a clinical evaluation.
• AI-generated health insights are informational only and should not be used to make medical decisions.
• Health measurement tracking (blood pressure, glucose, weight, etc.) is for personal record-keeping only.

Always consult a qualified healthcare provider before making any decisions about your health, medications, or treatment. Do not disregard or delay seeking professional medical advice based on information from this app.

3. User Accounts

You may use Vitality365 as a guest without creating an account. If you choose to create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. You must be at least 13 years of age to create an account.

4. Acceptable Use

You agree to use Vitality365 only for lawful personal wellness tracking purposes. You agree not to attempt to gain unauthorized access to the service, reverse engineer the app, or use the app in any way that could harm other users or the service itself. We reserve the right to suspend access for violations of these terms.

5. Premium Features

Vitality365 offers a free tier with core wellness tracking features. Certain features, including the Caregiver Portal, may require a paid subscription. Subscription fees are billed through the App Store or Google Play and are subject to their respective refund policies. You may cancel your subscription at any time through your device's subscription management settings.

6. Data and Privacy

Your use of Vitality365 is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the app, you consent to the collection and use of your information as described in the Privacy Policy.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Vitality365 and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to health outcomes resulting from information provided by the app. Your use of Vitality365 is at your own risk.

8. Account Deletion

You may delete your account at any time from the Settings page. Upon deletion, your personal data and health records will be permanently removed from our systems within 30 days.

9. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting a notice within the app. Continued use of Vitality365 after changes are posted constitutes your acceptance of the updated terms.
